Contractual Acceptance & Electronic Records
How SULTRAFIED records agreement to its Terms, Privacy Policy, paid services and other contractual documents — and how those records may be used to establish what was accepted and when.
Purpose of this contractual acceptance framework
1.1 This Contractual Acceptance & Electronic Records provision explains how SULTRAFIED may obtain, record, retain and evidence a Member’s agreement to contractual documents and transaction-specific terms.
1.2 It applies to acceptance of documents including the SULTRAFIED Terms & Conditions, Privacy Policy, Creator Terms, payment or subscription terms and other contractual conditions expressly presented for acceptance.
1.3 Where a person affirmatively indicates acceptance through a checkbox, button, digital confirmation or other electronic process clearly identified as contractual acceptance, that indication may form part of the evidence that the person agreed to the relevant contract.
1.4 SULTRAFIED may maintain records sufficient to identify the contractual documents, versions, transaction and circumstances associated with that acceptance.
Registration requires active acceptance
2.1 Where SULTRAFIED requires acceptance of contractual Terms during registration, the Member must take an affirmative action indicating agreement before registration can be completed.
2.2 The principal contractual acceptance checkbox must not be treated as accepted merely because a Member visits the website, continues browsing or leaves a checkbox untouched.
2.3 The checkbox used to accept contractual Terms should be unticked by default and must be actively selected by the applicant.
2.4 The applicant must not be permitted to complete registration until every mandatory contractual acceptance required for that registration has been completed.
2.5 SULTRAFIED may separately require confirmation of age, Community Rules, Content requirements, Creator Terms, payment terms or other obligations where those confirmations are legally or operationally appropriate.
The Member must actively choose to accept.
The relevant documents must be accessible before the Member commits.
The backend should record the acceptance and corresponding document versions.
The Member should receive contractual confirmation in a retainable form where required.
Members must have an opportunity to read the Terms
3.1 Before contractual acceptance is requested, SULTRAFIED will make the relevant contractual documents reasonably accessible through the registration, purchase or other applicable process.
3.2 Important contractual information may be highlighted or summarised where appropriate so that significant provisions are not deliberately concealed from Members.
3.3 A Member is responsible for reviewing the contractual documents made available before indicating agreement.
3.4 Subject to applicable law, a Member’s decision not to read contractual documents that were clearly presented and reasonably accessible does not by itself prevent SULTRAFIED from relying upon an otherwise valid record of affirmative acceptance.
3.5 Nothing in this clause permits SULTRAFIED to rely upon a term that is invalid, unlawful, unfair or otherwise unenforceable under mandatory applicable law.
Information SULTRAFIED may record
4.1 To establish which contractual terms applied to an Account or transaction, SULTRAFIED may create and retain an electronic acceptance record.
4.2 Subject to applicable privacy and data-protection requirements, that record may include:
The Account associated with the acceptance.
For example Terms & Conditions, Privacy Policy or Creator Terms.
The version of each document presented at the time of acceptance.
The date and time that acceptance was recorded, preferably using UTC server time.
Registration, checkout, Creator onboarding, material Terms update or another process.
Where acceptance relates to a paid transaction.
IP address or similar security information where collection and retention are lawful, necessary and proportionate.
Limited technical information may be retained where appropriate to evidence or protect the transaction.
The actual wording displayed beside the checkbox or confirmation control.
Confirmation that the required affirmative action was successfully completed.
4.3 SULTRAFIED may generate a unique record identifier, document checksum, cryptographic hash or equivalent technical value to help establish that a stored version of a contractual document has not subsequently been altered.
4.4 Acceptance records may be stored separately from the live version of the website so that later amendments do not overwrite the historical contractual record.
SULTRAFIED should retain the version actually accepted
5.1 Each material contractual document may be assigned a version number and effective date.
5.2 When a Member accepts a contractual document, SULTRAFIED may record the specific version accepted.
5.3 Publishing a later version does not alter the historical record showing which version was presented and accepted at an earlier date.
5.4 SULTRAFIED may retain archived copies of historical contractual documents for evidence, complaints, contractual administration, legal claims and regulatory purposes.
Contract confirmation and a copy the Member can keep
6.1 Where required by applicable law or SULTRAFIED’s procedures, SULTRAFIED will provide contractual confirmation in a format that the Member can retain for future reference.
6.2 Confirmation may be supplied by email or another durable or retainable electronic format appropriate to the transaction.
6.3 A registration confirmation may identify:
6.4 Where a contract is confirmed by email, SULTRAFIED may include the relevant contractual terms in the email, attach a fixed copy, or otherwise provide them in a form the Member is reasonably able to save and reproduce.
6.5 Where evidence of the contractual version is important, SULTRAFIED should not rely solely on a hyperlink pointing to a web page whose contents may later be changed.
Paid purchases require transaction-specific agreement
7.1 A Member purchasing a paid membership, subscription, Content, event ticket, virtual item or other paid SULTRAFIED service may be required to confirm the transaction-specific terms before payment is submitted.
7.2 Information presented before the order should identify the price, material characteristics of the purchase, duration where relevant, renewal arrangements where applicable and other information required by applicable law.
7.3 The payment or checkout action should clearly indicate where completing the action creates an obligation to pay.
7.4 SULTRAFIED may retain an acceptance and transaction record including the applicable purchase terms, payment reference, date, price and contractual document versions.
7.5 Acceptance of the general Terms & Conditions does not prevent SULTRAFIED from requiring additional transaction-specific acceptance for a particular paid service.
Express consent for immediately supplied digital Content
8.1 Where applicable consumer law requires express consent before digital Content is supplied during a statutory cancellation period, SULTRAFIED may require a separate affirmative confirmation before providing immediate access.
8.2 Where required, the Member may also be required to acknowledge that beginning immediate supply affects or results in loss of the applicable statutory right to cancel once the relevant legal conditions are satisfied.
8.3 Any such confirmation should be separately recorded against the relevant transaction.
8.4 SULTRAFIED should not treat general Account registration consent as a substitute for a separate express confirmation where the law requires one for immediate supply of digital Content.
Material changes and renewed acceptance
9.1 SULTRAFIED may update its contractual documents in accordance with the Terms & Conditions and applicable law.
9.2 Where a change is sufficiently material that SULTRAFIED considers renewed affirmative acceptance appropriate or where such acceptance is legally required, continued access to relevant functionality may be conditional upon acceptance of the updated Terms.
9.3 A renewed acceptance record may identify both the old and new contractual versions and the date the updated terms were accepted.
9.4 SULTRAFIED may notify Members of material changes through email, Account notification, an in-Service notice or another appropriate communication method.
9.5 Nothing in this provision gives SULTRAFIED an unrestricted right to impose unfair retrospective contractual changes or remove mandatory consumer rights.
Acceptance records may be relied upon as evidence
10.1 SULTRAFIED may rely upon its reasonably maintained Account, acceptance, transaction and system records as evidence of the contractual process associated with an Account or transaction.
10.2 Such records may be used in connection with customer support, complaints, payment disputes, chargebacks, legal proceedings, regulatory enquiries, fraud investigations or other legitimate purposes.
10.3 Acceptance records are evidence and are not declared by these Terms to be legally conclusive where applicable law entitles a Member or another person to challenge their accuracy.
10.4 SULTRAFIED may use reasonable technical safeguards to protect historical acceptance records against unauthorised alteration or deletion.
10.5 Fraudulent alteration, fabrication or manipulation of contractual evidence by a Member may constitute a serious breach of the SULTRAFIED Terms.
Retention of contractual records
11.1 SULTRAFIED may retain contractual acceptance records for as long as reasonably necessary for the purposes for which they were collected and for applicable contractual, accounting, legal, regulatory, fraud-prevention, dispute and limitation-period requirements.
11.2 Closing an Account does not automatically require immediate deletion of contractual evidence that SULTRAFIED reasonably needs to establish the historic relationship between the Member and SULTRAFIED.
11.3 Contractual records must not be retained indefinitely without a legitimate basis merely because storage is technically possible.
11.4 Processing and retention of personal information contained in such records remains subject to the SULTRAFIED Privacy Policy and applicable data-protection law.
Acceptance made through a Member Account
12.1 A Member must protect their Account credentials and must not permit another person to accept contracts or make purchases through their Account without authority.
12.2 Where contractual acceptance or a transaction is recorded through a Member’s authenticated Account, SULTRAFIED may reasonably treat that Account activity as originating from the Member unless SULTRAFIED knows or ought reasonably to know that the Account has been compromised or misused.
12.3 Members must notify SULTRAFIED promptly if they believe their Account has been compromised or used to enter a transaction without authority.
12.4 Nothing in this provision makes a Member responsible for unauthorised activity to the extent applicable law places responsibility on SULTRAFIED, a payment provider or another person.

Where the applicable consumer rules require express consent and acknowledgement before digital Content is supplied immediately, use a separate acceptance control such as the following.
What your WordPress system should actually store
The visible checkbox is only the front end. The SULTRAFIED backend should create an immutable or appropriately protected acceptance record when the registration or transaction succeeds.

A user can alter hidden HTML values using browser developer tools. Your WordPress/PHP backend should obtain the current canonical document versions from the server and write those versions to the acceptance record itself.
Responsibility and evidential limitations
17.1 SULTRAFIED will use reasonable measures to maintain contractual acceptance records, but no electronic storage or information system can be guaranteed to be immune from every technical failure, cyber incident, corruption event or circumstance outside reasonable control.
17.2 To the maximum extent permitted by applicable law, SULTRAFIED is not responsible for a Member’s failure to retain contractual confirmation, maintain access to their email account or update their contact information, except where the resulting loss was caused by SULTRAFIED’s breach of a legal duty owed to that Member.
17.3 SULTRAFIED does not warrant that a contractual acceptance record will automatically determine the outcome of a legal dispute. The legal effect and evidential weight of any record remain subject to applicable law and, where relevant, determination by a competent court or authority.
17.4 Nothing in this provision excludes or limits liability, consumer rights or contractual protections that cannot lawfully be excluded or restricted.
