Member Content Licence
Your Content remains yours. This licence gives SULTRAFIED the limited rights required to host, process, protect, moderate and deliver your Content through the Service while respecting the access settings you select.
Uploading Content does not transfer ownership to SULTRAFIED.
You retain the rights you own. By uploading Content you give SULTRAFIED the limited permissions reasonably needed to operate the Platform, deliver Content according to your selected visibility settings, protect the community and comply with legal and safeguarding obligations.
You retain ownership of your Member Content
1.1 Except for rights owned by another person, you retain ownership of the copyright and other intellectual property rights that you hold in photographs, videos, audio, written material, recordings and other Content that you upload, publish, send, submit, sell or otherwise make available through SULTRAFIED (“Member Content”).
1.2 Uploading, storing, publishing, sending or otherwise making Member Content available through SULTRAFIED does not transfer ownership of your copyright to SULTRAFIED.
1.3 SULTRAFIED acquires only the licence and permissions expressly described in this Member Content Licence and elsewhere in the Terms & Conditions.
Your copyright remains yours, subject to any rights belonging to other people.
Only the rights reasonably required to operate, protect and administer the Service.
Limited licence to operate the Service
2.1 By uploading or otherwise making Member Content available through SULTRAFIED, you grant SULTRAFIED a non-exclusive, worldwide, limited, royalty-free licence to use that Member Content only as reasonably necessary to provide, operate, maintain, secure, moderate, improve and administer the Service in accordance with these Terms.
2.2 The licence includes permission for SULTRAFIED to:
Host and store Member Content on systems used to operate SULTRAFIED.
Make technical copies, temporary copies, cached copies and backup copies.
Convert photographs, video and audio into formats required by different devices and delivery systems.
Resize, compress and optimise files for performance and presentation.
Create thumbnails, previews, poster frames and other technically necessary versions.
Apply SULTRAFIED or security watermarks where the Service provides or requires them.
Technically transmit, stream and deliver Content to authorised recipients.
Display Member Content to the audience permitted by your selected access settings.
Analyse, review, classify, restrict or process Content for safety and moderation purposes.
Process Content for security, abuse prevention, fraud detection and safeguarding.
Deliver authorised Creator or paid Content to Members entitled to receive it.
Preserve, process or disclose Content where reasonably required by applicable law or lawful authority.
2.3 This licence also permits SULTRAFIED to use Member Content as reasonably necessary to operate profiles, feeds, galleries, private galleries, messaging, Creator features, search, discovery, notifications, moderation, reporting, safety systems and other functionality that you choose to use.
Your selected visibility settings
3.1 Subject to moderation, safety, legal, technical and enforcement requirements, SULTRAFIED will use reasonable measures to make Member Content available in accordance with the visibility and access settings selected by you.
Content may be displayed to the audience identified as public by the relevant feature.
Content may be limited to eligible registered SULTRAFIED Members.
Content is intended for Members currently authorised through the friends functionality.
Private Content is intended only for Members to whom access has been specifically granted.
3.2 The fact that SULTRAFIED possesses a technical, backup or moderation copy of private or restricted Content does not itself authorise SULTRAFIED to make that Content available to the general Member population.
3.3 When you change a Content visibility setting, the new setting will apply prospectively after the change has been processed by SULTRAFIED’s systems.
3.4 Changing visibility does not require SULTRAFIED to recover copies already lawfully received, viewed or obtained by another person before the change.
SULTRAFIED does not acquire the right to sell your private photographs
4.1 The Member Content Licence does not give SULTRAFIED a general right to sell, license, distribute, publish or commercially exploit your private or restricted Member Content outside the Service for unrelated third-party use.
4.2 In particular, uploading a private photograph, video or other restricted Content does not by itself give SULTRAFIED permission to sell that Content to an advertiser, media organisation, data broker, adult Content business or other unrelated third party for that third party’s independent commercial use.
4.3 The licence also does not give SULTRAFIED a general right to use identifiable private Member Content in external advertising campaigns, publicity or promotional material unrelated to ordinary operation of the Service.
4.4 Where SULTRAFIED wishes to use identifiable Member Content for a materially different external marketing or promotional purpose, we will obtain any additional permission required by applicable law and our contractual arrangements.
4.5 Nothing in this section prevents SULTRAFIED from using SULTRAFIED-owned Content, appropriately licensed Content, non-identifiable material, aggregated data or material for which separate permission has been obtained.
SULTRAFIED may technically process your Content
5.1 You authorise SULTRAFIED to make technical modifications to Member Content where reasonably necessary to operate, secure or deliver the Service.
5.2 Technical processing may include:
5.3 Such technical permission does not give SULTRAFIED a general right to materially change the meaning of Member Content, fabricate statements by you or falsely represent that you performed an act that you did not perform.
Limited use by SULTRAFIED service providers
6.1 SULTRAFIED may permit hosting providers, cloud providers, content-delivery networks, storage providers, security providers, moderation providers, Content-processing providers and other contractors acting for SULTRAFIED to process Member Content where reasonably necessary to provide services to SULTRAFIED.
6.2 The licence granted by you therefore includes the limited right for SULTRAFIED to sublicense or otherwise authorise those service providers to perform activities that SULTRAFIED itself is permitted to perform under this Member Content Licence.
6.3 Such permission is limited to services performed for or on behalf of SULTRAFIED and does not grant those providers an independent right under this licence to commercially exploit Member Content for unrelated purposes.
6.4 Processing of personal information by SULTRAFIED and its processors is also subject to the SULTRAFIED Privacy Policy and applicable data-protection law.
Creator, subscription and paid Member Content
7.1 Where authorised SULTRAFIED functionality allows a Member or Creator to sell, unlock, subscribe to or otherwise monetise Member Content, you authorise SULTRAFIED to host, process, display and technically deliver that Content to Members who are entitled to access it under the applicable transaction.
7.2 The expression “royalty-free” in this Member Content Licence means that SULTRAFIED does not owe you a separate copyright licence fee merely because SULTRAFIED performs technical processing necessary to operate the Service.
7.3 It does not cancel or reduce any Creator payment, revenue share, transaction payment or other amount that SULTRAFIED has separately agreed to pay under applicable Creator Terms or transaction terms.
7.4 Paid or Creator Content remains subject to all SULTRAFIED safety, consent, age, intellectual property, moderation and Content rules.
You are responsible for having the right to upload the Content
8.1 Each time you upload, publish, sell, send or otherwise make Member Content available through SULTRAFIED, you represent and warrant that:
you own the relevant Member Content or have sufficient rights and authority to upload it and grant the licence contained in this document;
SULTRAFIED’s use of the Member Content in accordance with these Terms will not, so far as you are aware, infringe another person’s copyright, performers’ rights or other intellectual-property rights;
you have obtained every permission, authorisation and consent legally required from identifiable adults depicted, recorded or otherwise represented in the Content;
every real person depicted in sexual, nude, intimate or other adult Member Content was at least 18 years old at the time the Content was created;
you are legally entitled to make the Content available to the audience you have selected;
the Content does not constitute Intimate Image Abuse Content or another form of non-consensual Content;
the Content is not unlawful, fraudulent, defamatory, exploitative or otherwise prohibited by SULTRAFIED’s Terms or Community Rules; and
any information or evidence you provide to establish age, identity, ownership or consent is genuine and accurate.
Content involving another person
9.1 The licence you grant to SULTRAFIED applies only to rights that you are legally entitled to grant.
9.2 Uploading a photograph or video does not give you ownership of another person’s copyright, performers’ rights, privacy rights, data-protection rights, confidentiality rights or other legal rights.
9.3 Where another identifiable adult appears in Member Content, you are responsible for ensuring that any consent or other legal authority required for the intended use has been obtained.
9.4 Permission to create or possess an intimate photograph or recording does not automatically amount to permission to upload, publish, sell, distribute or share it through SULTRAFIED.
9.5 You must not rely upon this Member Content Licence as authority to publish another person’s Content where you never possessed the rights or consent necessary to do so.
Privacy controls cannot guarantee that another person will not copy Content
10.1 SULTRAFIED may provide technical controls intended to reduce unauthorised copying or redistribution, including private galleries, restricted access, one-time viewing, disabled download functionality, watermarking and similar measures.
10.2 No online technical control can guarantee that an authorised recipient will not attempt to retain, photograph, screen-record, capture, reproduce, redistribute or otherwise misuse Content.
10.3 You should therefore consider carefully the Content you choose to share and the persons to whom you grant access.
10.4 SULTRAFIED does not authorise another Member to copy, redistribute or misuse Member Content merely because that Member was permitted to view it.
10.5 Unauthorised copying, recording, redistribution or misuse may breach these Terms, applicable law and the rights of the person who owns or appears in the Content.
10.6 To the maximum extent permitted by applicable law, SULTRAFIED is not responsible for unauthorised copying, screen capture, recording, disclosure or other misuse carried out independently by another Member or third party where that loss was not caused by SULTRAFIED’s breach of a legal duty owed to you.
Only share intimate or sensitive Content with people you are comfortable allowing to view it.
What happens when you delete Content
11.1 Subject to the exceptions set out in this licence, when you delete Member Content, SULTRAFIED’s licence to use that Content for ordinary ongoing display through your Account will end within a reasonable period required to process the deletion.
11.2 Deletion from ordinary Member access does not necessarily result in immediate deletion from every cache, backup, disaster-recovery system, moderation system, security system or evidential record.
11.3 Residual technical copies may remain until overwritten or deleted in accordance with SULTRAFIED’s ordinary retention, backup and security processes.
11.4 A residual backup copy will not ordinarily be restored to Member-facing access merely because it remains in a backup system.
SULTRAFIED may preserve Content after deletion where necessary
12.1 Deleting Member Content, withdrawing ordinary access, changing a visibility setting or closing an Account does not require SULTRAFIED immediately to destroy a copy that SULTRAFIED reasonably needs to retain for a legitimate and lawful purpose.
12.2 SULTRAFIED may preserve Member Content and associated information where reasonably necessary for:
12.3 Where Content is retained solely for one of these purposes, SULTRAFIED may remove or restrict ordinary Member access while retaining the information for the period reasonably necessary or legally required.
12.4 SULTRAFIED may also preserve relevant records where deletion would materially prejudice an active safety, fraud, abuse, legal or regulatory investigation.
The licence does not override consent or Content-removal rules
13.1 Nothing in this licence authorises Intimate Image Abuse Content, unlawful Content, child sexual abuse material or other prohibited Content.
13.2 Where SULTRAFIED receives a credible report that intimate or private Content was uploaded or is being displayed without appropriate authority or consent, SULTRAFIED may immediately restrict access while the matter is reviewed.
13.3 SULTRAFIED may request evidence of identity, ownership, age, authority or consent from the uploader or other relevant persons.
13.4 SULTRAFIED may preserve evidence and remove or disable Content where required by our policies, applicable law or reasonable safeguarding measures.
13.5 An uploader cannot rely upon a licence granted to SULTRAFIED as a defence to their own unlawful, unauthorised or non-consensual publication of another person’s Content.

14.1 The Member Content Licence does not require SULTRAFIED to host, publish, continue hosting or restore any particular Member Content.
14.2 SULTRAFIED may remove, restrict, quarantine, blur, disable, limit distribution of or otherwise take appropriate action concerning Member Content where we reasonably believe action is necessary for:
14.3 SULTRAFIED may take temporary precautionary action before completing an investigation where continuing access could reasonably create a safety, legal, privacy, consent or evidential risk.
14.4 Removal or restriction of Content does not constitute an admission by SULTRAFIED that the Content was unlawful or that any allegation made against the uploader is correct.
Claims caused by Content you upload
15.1 You remain responsible for Member Content that you upload, publish, sell, send or otherwise make available and for ensuring that your use of that Content complies with these Terms and applicable law.
15.2 To the extent permitted by law, you may be responsible for reasonably foreseeable losses, costs or claims suffered by SULTRAFIED that are directly caused by your unlawful Content or your material breach of the warranties in this Member Content Licence.
15.3 This may include claims alleging that Content uploaded by you:
15.4 Nothing in this section makes a consumer responsible for a loss to the extent that the loss was caused by SULTRAFIED’s own breach of a legal duty or where applicable law prevents such liability being imposed.
15.5 Where you upload or monetise Member Content in the course of a trade, business, profession or commercial Creator activity rather than acting as a consumer, then, to the extent permitted by law, you agree to indemnify SULTRAFIED against third-party claims, liabilities, damages and reasonable external legal costs arising directly from:
(a) your infringement of another person’s intellectual-property rights;
(b) your failure to obtain legally required consent or authority for Content you supplied;
(c) false age, identity, ownership or consent information supplied by you; or
(d) unlawful Content knowingly or negligently supplied by you,
except to the extent that the relevant claim or loss was caused by SULTRAFIED’s own breach, negligence or other act for which liability cannot lawfully be excluded.
SULTRAFIED liability relating to Member Content
16.1 Member Content is supplied by Members and other users. Except where expressly stated, SULTRAFIED does not warrant that Member Content is accurate, authentic, lawful, complete, non-infringing or supported by all necessary permissions.
16.2 SULTRAFIED may use moderation, verification, automated systems and other safety measures, but no system can identify or prevent every unlawful, unauthorised, deceptive or harmful item of Content.
16.3 To the maximum extent permitted by applicable law, SULTRAFIED is not responsible for loss or damage arising from:
16.4 Nothing in this Member Content Licence excludes or restricts liability that cannot lawfully be excluded or restricted.
16.5 In particular, nothing in this document excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any mandatory consumer right that applicable law does not permit SULTRAFIED to exclude.
16.6 Where SULTRAFIED is legally responsible for a loss, liability will be determined in accordance with applicable law and the liability provisions of the SULTRAFIED Terms & Conditions.
Deletion does not automatically reverse completed transactions
17.1 Deleting Content or closing an Account does not automatically cancel, reverse or refund a transaction lawfully completed before deletion.
17.2 Where Member Content was purchased, unlocked, subscribed to or otherwise supplied through authorised SULTRAFIED functionality, continued access, withdrawal of access, refunds and retention will be governed by the applicable transaction terms, Creator Terms, consumer law and any overriding safety or legal requirement.
17.3 Nothing in this clause prevents SULTRAFIED from removing paid Content where continued availability would be unlawful or where removal is reasonably necessary because of consent, safeguarding, privacy, intellectual-property or other serious concerns.
Duration and termination of the licence
18.1 Subject to the provisions concerning technical copies, completed transactions, moderation, evidence preservation, complaints, disputes and legal obligations, SULTRAFIED’s ordinary operational licence to Member Content ends when:
and is no longer made available through the ordinary Service.
and the Content is no longer required for an authorised surviving purpose.
18.2 Rights necessary to deal with backups, complaints, completed transactions, legal claims, enforcement, safety investigations, evidence preservation or legal obligations survive only to the extent and for the period reasonably necessary for those purposes.
Moral rights and attribution
19.1 Nothing in this Member Content Licence transfers your moral rights to SULTRAFIED.
19.2 To the extent permitted by law, you consent to the limited technical processing described in this document.
19.3 You acknowledge that the ordinary technical operation of profiles, galleries, feeds, messaging, thumbnails, previews and other Service functionality may not display copyright authorship or attribution information on every occasion.
19.4 SULTRAFIED must not knowingly use this Member Content Licence as authority to falsely attribute your Content to another person.
Hosting Content is not endorsement
20.1 SULTRAFIED’s hosting, processing, moderating, transmitting or displaying Member Content does not mean that SULTRAFIED:
20.2 Any verification badge, moderation status, visibility status or availability of Member Content must not be interpreted as a SULTRAFIED warranty concerning the uploader or the Content unless SULTRAFIED expressly states otherwise.
Business restructuring or transfer
21.1 If ownership or operation of SULTRAFIED is lawfully transferred as part of a merger, acquisition, sale, restructuring or transfer of the relevant business or assets, the benefit of this limited Member Content Licence may transfer to the successor operator where reasonably necessary to continue providing the Service.
21.2 Such transfer does not expand the licence. A successor receiving the licence under this clause remains subject to the limitations applicable to the licence at the time of transfer, subject to any lawful later variation of the Terms.
21.3 Personal-data transfers remain subject to applicable data-protection law and the SULTRAFIED Privacy Policy.
How this licence must be interpreted
22.1 This Member Content Licence must be interpreted so that SULTRAFIED receives the rights reasonably necessary to operate, deliver, secure, moderate and lawfully administer the Service rather than ownership of Member Content or an unrestricted commercial licence.
22.2 Where another provision of the SULTRAFIED Terms gives SULTRAFIED a right to preserve, remove, restrict, investigate or disclose Content for safety, legal, regulatory or enforcement purposes, that provision operates alongside this Member Content Licence.
22.3 Nothing in this document removes any mandatory consumer, copyright, privacy, data-protection or other legal right that cannot lawfully be excluded.
