Payments, Memberships & Subscription Terms

The contractual rules governing SULTRAFIED memberships, recurring subscriptions, digital purchases, payment processing, refunds, cancellations, failed payments, chargebacks, virtual credits and other paid services.

IMPORTANT PAYMENT TERMS

Always review the price, duration and renewal terms before you pay.

The checkout information presented immediately before purchase forms part of your transaction with SULTRAFIED. Where a membership or service renews automatically, this will be identified before you place the order.

Read Payment Terms

When these Payment Terms apply

1.1 These Payments, Memberships & Subscription Terms (“Payment Terms”) apply whenever you purchase or use a paid SULTRAFIED product, service, membership, subscription, digital item, virtual item or other paid functionality.

1.2 They operate alongside the SULTRAFIED Terms & Conditions and any additional terms shown before the relevant purchase.

1.3 Creator sales may also be subject to the Creator Terms and transaction-specific information displayed before purchase.

1.4 Club and event payments may be subject to separate Club, Event & Ticket Terms.

1.5 Where transaction-specific information conflicts with these Payment Terms in relation to matters such as price, duration or renewal period, the information clearly presented and accepted for that particular transaction will apply, subject to applicable law.

Prices and purchase information

2.1 The price payable for a SULTRAFIED purchase will be displayed before the Member submits the order.

2.2 Where applicable, the checkout will identify material information including:

PRICE Total amount payable
DURATION Membership or access period
BILLING Billing frequency
RENEWAL Whether automatic renewal applies
CURRENCY Transaction currency
TAX Applicable taxes where required
CONTENT What is being purchased
CANCELLATION Material cancellation conditions

2.3 You are responsible for reviewing that information before submitting payment.

2.4 SULTRAFIED may offer different products, prices, currencies, promotions or membership arrangements in different territories or through different lawful sales channels.

2.5 Except where prohibited by law, the fact that another Member has been offered a different lawful price or promotion does not create an entitlement to that Member’s price.

Authorising a payment

3.1 By submitting a paid order, you authorise the applicable amount to be charged using the payment method selected by you.

3.2 You confirm that you are authorised to use the payment method supplied.

3.3 You must not knowingly use a stolen, unauthorised, fraudulent or improperly obtained payment method.

3.4 SULTRAFIED may delay or refuse a transaction where reasonably necessary because of fraud, security, sanctions, regulatory, payment-provider or other legitimate concerns.

3.5 An attempted payment does not guarantee successful activation of a paid service.

3.6 Paid access will ordinarily begin only after the transaction has been successfully authorised or otherwise accepted by the relevant payment system.

Recurring subscriptions

4.1 Some SULTRAFIED paid memberships or other services may be offered as recurring subscriptions.

4.2 A subscription will renew automatically only where that renewal arrangement has been clearly disclosed before purchase.

4.3 Where automatic renewal applies, you authorise SULTRAFIED or its authorised payment provider to charge the applicable subscription amount at each renewal until the subscription is cancelled or otherwise ends.

4.4 The applicable billing period may be monthly, quarterly, annual or another period expressly shown before purchase.

4.5 You should keep your payment information current.

4.6 Cancellation of automatic renewal prevents future renewal charges after the cancellation takes effect but does not automatically reverse charges already lawfully incurred.

IMPORTANT SULTRAFIED will not treat a one-off purchase as an automatically renewing subscription unless recurring billing was disclosed as part of that purchase.

Renewal of a paid subscription

5.1 Where a subscription automatically renews, the subscription will continue for the renewal period disclosed to you unless cancelled.

5.2 Where required by law, or where SULTRAFIED determines it appropriate, renewal reminders or notices may be provided before a renewal payment.

5.3 Renewal notices may be sent by email, Account notification or another communication method associated with your Account.

5.4 You are responsible for keeping your Account contact information accurate.

5.5 Failure to read a properly sent renewal notification does not automatically invalidate an otherwise lawful renewal, subject to applicable consumer law.

Cancelling a recurring subscription

6.1 A Member may cancel a recurring SULTRAFIED subscription using the cancellation method made available for that subscription.

6.2 SULTRAFIED aims to make subscription cancellation reasonably straightforward.

6.3 Unless otherwise required by law or expressly stated, cancellation of future renewal ordinarily means:

01 Future renewal stops

No further subscription charge should be taken after cancellation has validly taken effect.

02 Current access may continue

Paid access may continue until the end of the period already paid for.

03 Account may remain open

Cancelling paid membership does not necessarily delete the underlying SULTRAFIED Account.

04 No automatic retrospective refund

Cancellation does not itself create a refund for a period already supplied unless these Terms or applicable law require one.

6.4 Closing an Account and cancelling a subscription may be separate actions.

6.5 Members should cancel recurring billing before closing an Account where the Account process does not automatically cancel it.

Consumer cooling-off rights

7.1 Where applicable consumer law gives you a statutory right to cancel a distance contract, SULTRAFIED will honour that right.

7.2 UK consumers will generally have a 14-day cancellation period for qualifying distance service contracts beginning after the contract is entered into, subject to statutory exceptions and rules concerning services begun during that period.

7.3 Different rules may apply to digital Content supplied immediately, as explained below.

7.4 Where you expressly ask SULTRAFIED to begin providing a qualifying service during a cancellation period, you may be required to pay a proportionate amount for services already supplied if applicable law permits.

7.5 Nothing in these Payment Terms removes a statutory cancellation right that cannot lawfully be excluded.

Immediately supplied digital Content

8.1 Some paid photographs, videos, galleries, downloads, streams or other digital Content may become available immediately after purchase.

8.2 Where applicable law requires it, before immediate digital supply begins SULTRAFIED will obtain:

EXPRESS REQUEST Immediate supply

You expressly request that digital supply begins without waiting for the cancellation period to expire.

ACKNOWLEDGEMENT Cancellation consequences

You acknowledge the applicable effect of immediate supply on your statutory cancellation right.

8.3 Where the statutory conditions for loss of the cancellation right have been satisfied, the Member may lose the right to cancel that digital-Content transaction after supply begins.

8.4 Nothing in this clause removes statutory remedies concerning faulty, misdescribed or unlawfully supplied digital Content.

Trials and promotional subscriptions

9.1 SULTRAFIED may offer free trials, discounted introductory periods or promotional subscription prices.

9.2 The material conditions of the offer will be shown before purchase or activation.

9.3 Where a trial converts automatically into a paid subscription, that fact and the relevant price will be disclosed before the Member enters the trial.

9.4 Unless otherwise stated, promotional offers:

may be limited to eligible Members;
may be limited to one use per Member;
may have a stated expiry date;
may not be transferable;
may not be combined with other offers; and
may be withdrawn prospectively before acceptance.

9.5 SULTRAFIED may refuse repeated creation of Accounts intended to abuse trial or promotional eligibility.

Changes to subscription prices

10.1 SULTRAFIED may change the price of a recurring subscription prospectively.

10.2 A price change will not retrospectively alter the amount properly charged for a completed billing period.

10.3 Where required by law or the contractual arrangement, reasonable advance notice of a price increase will be provided before it affects a future renewal.

10.4 The notice may identify:

New price
Effective date
Affected billing period
Cancellation method
Other material changes

10.5 Where applicable law requires affirmative agreement rather than notice alone, SULTRAFIED will obtain that agreement before applying the change.

Declined and failed subscription payments

11.1 Where a recurring payment fails, SULTRAFIED or its payment provider may make reasonable further attempts to collect the payment where permitted by the transaction arrangement.

11.2 SULTRAFIED may notify the Member and request an updated payment method.

11.3 If payment remains outstanding, SULTRAFIED may:

suspend paid membership;
remove access to paid features;
downgrade the Account where appropriate;
cancel the relevant subscription;
restrict further purchases; or
recover sums lawfully due.

11.4 SULTRAFIED is not required to continue supplying a paid service indefinitely where the required payment has not been received.

Payment processors and financial institutions

12.1 Payments may be processed using independent banks, card networks, digital-wallet providers, payment gateways, merchant acquirers or other authorised payment-service providers.

12.2 Those providers may apply their own lawful security, authentication, fraud-prevention and transaction requirements.

12.3 SULTRAFIED may share or receive transaction information with payment providers as described in the Privacy Policy and as reasonably necessary to administer payments.

12.4 A payment provider may decline, delay, reverse or investigate a transaction independently of SULTRAFIED.

12.5 To the extent permitted by law, SULTRAFIED is not responsible for failures solely caused by an independent payment provider, issuing bank, card network or financial institution and outside SULTRAFIED’s reasonable control.

12.6 Nothing in this clause removes responsibility for matters caused by SULTRAFIED’s own breach of a legal duty.

When refunds may be provided

13.1 Refunds will be provided where required by applicable law.

13.2 SULTRAFIED may also provide a refund or account credit where expressly provided by the applicable purchase terms or where SULTRAFIED determines that doing so is appropriate.

13.3 A refund request does not automatically establish an entitlement to a refund.

13.4 In deciding a non-statutory refund request, SULTRAFIED may consider matters including:

Whether the service was supplied
Whether digital Content was accessed
Whether a purchase was duplicated
Whether the transaction was unauthorised
Whether Content was materially misdescribed
Whether a technical failure occurred
Whether misuse or fraud is suspected
Applicable statutory rights

13.5 Where a partial refund is appropriate, SULTRAFIED may refund only the amount properly attributable to the affected part of the transaction where legally permitted.

13.6 A Member is not entitled to duplicate recovery by obtaining both a SULTRAFIED refund and retaining the same amount obtained through a successful chargeback or other reimbursement.

Chargebacks and disputed transactions

14.1 Nothing in these Payment Terms prevents a Member from exercising a legitimate right to dispute an unauthorised or otherwise properly disputable transaction with their payment provider.

14.2 Members must not knowingly submit a false, fraudulent or materially misleading chargeback claim.

14.3 Where a transaction is disputed, SULTRAFIED may provide relevant transaction evidence to its payment processor, acquiring bank, card network or other authorised dispute handler.

14.4 That evidence may include, where lawful and relevant:

Account information
Transaction date and amount
Purchase description
Acceptance records
Access or delivery records
Relevant technical evidence

14.5 Where a chargeback is legitimately upheld, access to the relevant paid service or purchase may be removed.

14.6 Fraudulent chargeback abuse may result in purchase restrictions, Account suspension or other proportionate action.

Virtual credits, gifts and digital items

15.1 SULTRAFIED may provide virtual credits, tokens, points, gifts, icons or other digital items (“Virtual Items”).

15.2 Unless SULTRAFIED expressly states otherwise, Virtual Items:

No legal tender

They are not money, currency or a bank deposit.

No general cash value

They cannot ordinarily be redeemed for cash.

Personal licence

They are provided for permitted use within SULTRAFIED.

No unauthorised resale

They must not be sold or traded outside authorised functionality.

15.3 Virtual Items are distinct from Creator earnings or other monetary balances expressly designated as payable to a Creator.

15.4 SULTRAFIED may impose reasonable expiry, use, transfer or promotional conditions where those conditions are disclosed before acquisition or where legally permitted.

15.5 Promotional credits supplied without payment may be withdrawn or expire according to the promotional conditions attached to them.

15.6 Purchased Virtual Items will be treated in accordance with applicable consumer law and the terms disclosed at purchase.

Account closure and unused paid benefits

16.1 A Member who voluntarily closes an Account may lose access to remaining Account-specific features, Content and benefits associated with that Account.

16.2 Members should consider cancelling recurring subscriptions before closing an Account.

16.3 Subject to mandatory consumer rights, voluntary Account deletion does not automatically create a refund for a membership period, digital item or other benefit already supplied.

16.4 Where SULTRAFIED terminates paid access because of a serious breach, refund entitlement will depend on the circumstances, these Terms and applicable law.

16.5 SULTRAFIED will not rely on this clause to keep money that applicable law requires us to refund.

Promotional offers

17.1 Promotional codes, Member discounts, referral benefits and similar offers are subject to any conditions communicated with the offer.

17.2 Unless otherwise stated, promotional offers are:

non-transferable;
limited to eligible Accounts;
limited to the stated period;
not exchangeable for cash;
subject to stated usage limits; and
capable of being refused where fraud or abuse is reasonably suspected.

17.3 SULTRAFIED may correct obvious promotional errors before a contract is concluded.

Currency conversions and additional bank charges

18.1 Transactions may be offered in one or more currencies.

18.2 Your bank, card issuer or payment provider may convert the transaction into another currency and may apply its own exchange rate or foreign-transaction charge.

18.3 Unless SULTRAFIED expressly imposes the relevant charge itself, SULTRAFIED does not control fees independently imposed by your bank, card issuer or wallet provider.

18.4 Applicable taxes will be included or separately identified where required by law.

Pricing and transaction errors

19.1 SULTRAFIED may correct an obvious pricing, calculation or technical error before a binding transaction is concluded.

19.2 If an obvious error is discovered after payment, SULTRAFIED may contact the Member and, where legally appropriate:

honour the transaction;
offer the correct price;
cancel and refund the transaction; or
agree another lawful resolution.

19.3 SULTRAFIED will not use this clause to retrospectively change a correctly stated price merely because the transaction later becomes commercially inconvenient.

Fraud prevention and transaction monitoring

20.1 SULTRAFIED may use manual and automated measures to detect suspected payment fraud, Account compromise, promotional abuse, unusual purchasing activity and other payment-related risk.

20.2 SULTRAFIED may temporarily delay a payment, withdrawal, refund, purchase or Account feature while a genuine risk is investigated.

20.3 Where reasonably necessary, SULTRAFIED may request additional verification before completing or reinstating a transaction.

20.4 SULTRAFIED may preserve and disclose relevant payment evidence where reasonably required for fraud prevention, chargeback handling, legal claims, payment-provider investigations or compliance with law.

SULTRAFIED liability for payments and subscriptions

21.1 Nothing in these Payment Terms excludes or restricts liability that cannot lawfully be excluded or restricted.

21.2 Nothing in these Terms limits mandatory consumer rights concerning paid services or digital Content.

21.3 Subject to those mandatory rights, SULTRAFIED is not responsible for losses caused solely by:

incorrect payment details supplied by the Member;
an issuing bank declining payment;
an independent payment-provider outage;
foreign exchange charges imposed by a Member’s bank;
fraudulent use caused by the Member deliberately sharing payment credentials;
a Member failing to cancel an auto-renewing subscription after clear renewal disclosure;
circumstances outside SULTRAFIED’s reasonable control; or
loss not caused by a breach of legal duty by SULTRAFIED.

21.4 SULTRAFIED does not guarantee that every third-party payment method or provider will remain continuously available.

21.5 SULTRAFIED may add, remove or replace supported payment methods where reasonably necessary.

21.6 Where SULTRAFIED is legally responsible for loss, liability will be determined in accordance with applicable law and the liability provisions of the SULTRAFIED Terms & Conditions.

LEGAL RIGHTS No sentence on this page is intended to exclude fraud, death or personal injury caused by negligence, mandatory consumer remedies or another liability that the law does not permit SULTRAFIED to exclude.

Future subscription-law requirements

22.1 Consumer subscription law and regulation may change during the operation of SULTRAFIED.

22.2 SULTRAFIED may update subscription processes, renewal notices, cancellation functionality, cooling-off arrangements and these Payment Terms where reasonably necessary to comply with new legal requirements.

22.3 Where applicable law introduces additional renewal notices, cooling-off rights or cancellation obligations, SULTRAFIED will apply those requirements from the date they become legally applicable.

22.4 This clause does not make a future legal requirement retrospectively applicable before its statutory commencement date.

Payment and contractual records

23.1 SULTRAFIED may create and retain lawful records of paid transactions.

23.2 Such records may include:

Account identifier
Order reference
Transaction amount
Currency
Purchase description
Subscription period
Renewal status
Contract version
Acceptance timestamp
Payment-provider reference

23.3 Records may be retained for contractual, accounting, tax, fraud-prevention, chargeback, complaints, legal and regulatory purposes in accordance with applicable law and the SULTRAFIED Privacy Policy.

Payment and refund complaints

24.1 If you believe you have been incorrectly charged, experienced duplicate billing, did not receive a purchase or have another payment problem, contact SULTRAFIED Help.

24.2 Please provide enough information for us to identify the Account and transaction.

24.3 SULTRAFIED may request reasonable verification before discussing detailed payment information.

24.4 Reporting a transaction promptly can assist SULTRAFIED in investigating suspected fraud or processing errors.
